Important: Nagomi's AI companions are fictional characters. They are not real people and are not a substitute for professional mental health support.

These Terms govern your use of the Nagomi mobile application. By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the App. By using Nagomi, you confirm that you are 18 or older. Accounts belonging to users under 18 will be terminated immediately.

2. AI Companions Disclaimer

The companions in Nagomi (Aria, Nora, Yuki) are AI-generated characters. All responses are produced by a language model and do not reflect the views or feelings of any real person. These characters:

Are not real people and do not have genuine emotions or consciousness.
Are not therapists, counselors, or mental health professionals.
Should not be relied upon for medical, legal, financial, or psychological advice.
May occasionally produce inaccurate or unexpected responses.

3. Account

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your account with others. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

Attempt to manipulate, reverse-engineer, or exploit the AI system.
Upload content that is illegal, harmful, or infringes on third-party rights.
Use the App in any way that could damage or impair our servers or services.
Attempt to extract or scrape data from the App or its API.

5. In-App Purchases

The App offers optional paid subscriptions (Spark, Flame) and virtual currency (Nagomi Coins) processed through Google Play Billing.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
Nagomi Coins have no real-world monetary value and cannot be refunded except as required by applicable law.
For refund requests, follow Google Play's refund policy.
We reserve the right to change pricing with reasonable notice.

6. User Content

By uploading photos or content to the App, you grant us a limited license to store and display that content solely to provide the App's features to you. We do not claim ownership of your content. You may delete it by deleting your account.

7. Termination

You may delete your account at any time via Settings. We may suspend or terminate your account for violations of these Terms. Upon termination, all your data will be permanently deleted.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, accuracy of AI responses, or fitness for any particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including reliance on AI-generated content.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance. We will make reasonable efforts to notify you of material changes.

11. Governing Law

These Terms are governed by the laws of Romania. Any disputes shall be resolved in the courts of Romania, unless otherwise required by applicable consumer protection law in your jurisdiction.
